EPA MSGP Permit Extension

The EPA’s 2021 Multi-Sector General Permit (MSGP) for industrial stormwater expired on February 28, 2026, but EPA hasn’t finalized the new permit yet. Because of that, the agency temporarily extended the current permit so facilities already covered can keep operating under the same requirements until the new permit is issued.
For facilities that already had coverage, nothing really changes right now. Their permit status automatically continues, and they should keep following the same MSGP requirements—like maintaining their SWPPP, performing inspections, and conducting monitoring—until the new permit is released.
For new facilities that didn’t have coverage before the permit expired, they can’t officially obtain MSGP coverage yet. However, EPA issued a “No Action Assurance,” meaning the agency won’t enforce permit violations for stormwater discharges as long as the facility follows the 2021 MSGP requirements and notifies EPA of its intent to comply.
Once EPA releases the new MSGP, facilities will need to submit a new Notice of Intent (NOI) within 90 days to obtain coverage under the updated permit.
✅ Bottom line: The old MSGP didn’t disappear - it’s basically on hold and still being used until the EPA finalizes the next version.
